US Court Declares Pentagon's Ban on Anthropic Unlawful

A US federal judge ruled that the Pentagon's sanctions against AI company Anthropic were illegal, citing retaliation for criticism.

A US federal judge has ruled that the sanctions imposed by the Trump administration on AI giant Anthropic were unlawful. The judge found that the government had punished the company for publicly criticizing the Pentagon. Judge Rita Lin's 59-page decision stated that the 'empty invocation of national security is not a blank check to punish and retaliate against government critics.' The ruling bars federal agencies from enforcing President Donald Trump's order to stop using Anthropic's tools and overturns Defense Secretary Pete Hegseth's designation of the company as a'supply chain risk.'

The conflict began when Anthropic refused to allow the US military to use its Claude AI models for fully autonomous lethal weapons or for mass surveillance of Americans. In response, President Trump lashed out at the company, calling it 'a radical left, woke company' and 'out-of-control.' The judge's ruling concluded that the sanctions were based on a desire to make a public example out of Anthropic for its criticism of the government rather than to counter a genuine threat.

The military had been using Anthropic's Claude AI across a range of classified and sensitive systems, including during the operation that captured Venezuelan leader Nicolas Maduro. The supply chain risk designation, formally made in March, had canceled Anthropic's military contracts and barred other Pentagon contractors from using its technology. However, Anthropic's victory is not total, as a second sanction based on public procurement regulations remains in effect pending a court ruling in Washington.

Anthropic CEO Dario Amodei has repeatedly warned about the dangers of AI, including its impact on jobs, which has drawn the ire of the White House. The company is expected to make a public stock market listing within weeks, potentially eclipsing SpaceX's record Wall Street debut in June, which raised $86.2 billion.

Anthropic welcomed the court's ruling, stating that the supply chain risk designation was unlawful. The company remains focused on working productively with the government to harness AI for national security, ensuring all Americans benefit from this technology.

This ruling has significant implications for the relationship between tech companies and the government, particularly concerning the use of AI in military applications. For Bangladesh, the case underscores the importance of maintaining a balance between national security interests and the free expression of companies operating in the global tech industry.
