Attorney General (AG) Md Ruhul Quddus Kazol today said there is no legal bar to Chattogram-2 Member of Parliament (MP) Sarowar Alamgir performing his duties as a lawmaker. The Appellate Division of the Supreme Court earlier removed a civil miscellaneous petition (CMP) from its cause list, filed by Bangladesh Jamaat-e-Islami candidate Muhammad Nurul Amin, who contested from the same constituency. The Jamaat leader had challenged a High Court judgment that upheld the nomination of BNP candidate Sarowar Alamgir for the Chattogram-2 seat. Following the High Court judgment, the Election Commission administered the oath to Sarowar Alamgir as a Member of Parliament, and he has since taken part in parliamentary proceedings.
The Jamaat-e-Islami candidate from the same constituency filed a civil miscellaneous petition (CMP) before the Appellate Division challenging the High Court verdict. The Appellate Division heard the CMP over two days and had fixed today for passing its order. Meanwhile, the full text of the High Court judgment was released yesterday (Tuesday). In this context, the Appellate Division today ordered that the CMP be struck off the cause list, as stated by the Attorney General.
Kazol further added that the opposing party may still file a regular civil petition against the High Court judgment if it wants. Advocate Mohammad Shishir Manir moved the plea for Muhammad Nurul Amin while senior jurists Ahsanul Karim and Barrister AM Mahbub Uddin Khokon stood for Sarowar Alamgir. Attorney General Md Ruhul Quddus Kazol argued for the state.
The High Court on July 9 made absolute a rule it had issued earlier, declaring the nomination of Sarowar Alamgir for the Chattogram-2 constituency valid. Earlier, the Election Commission (EC) had declared Sarowar Alamgir's nomination papers valid. However, his rival candidate from Bangladesh Jamaat-e-Islami, Muhammad Nurul Amin, filed an appeal alleging that Sarowar Alamgir was a loan defaulter. After hearing the appeal, the EC cancelled Sarowar’s candidacy. The BNP candidate later filed an appeal with the High Court, and on January 27, 2026, the court ordered the restoration of his nomination for the Chattogram-2 constituency. However, Muhammad Nurul Amin filed a petition seeking leave to appeal against the High Court order.
The Appellate Division of the Supreme Court subsequently granted leave to appeal and ordered that if Sarowar Alamgir was successful in the election, the declaration of his result would remain stayed until the final disposal of the appeal. Following the Appellate Division's directive, the High Court, after hearing the matter, on July 9 made the rule absolute, thereby declaring Sarowar Alamgir's nomination valid. The Jamaat leader later filed the CMP against the High Court verdict. This recent development allows Sarowar Alamgir to continue his parliamentary duties without legal impediment, maintaining the stability and functionality of the legislative process in Bangladesh.
