The High Court today made absolute a rule it had issued earlier, declaring the nomination of BNP candidate Sarowar Alamgir for the Chattogram-2 constituency valid. The High Court division bench of Justice Fahmida Quader and Justice Md Ashif Hasan pronounced the judgment this afternoon.
Background of the Case
Earlier, the Election Commission (EC) had declared Sarowar Alamgir's nomination papers valid. However, his rival candidate from Bangladesh Jamaat-e-Islami, Muhammad Nurul Amin, filed an appeal alleging that Sarowar Alamgir was a loan defaulter. After hearing the appeal, the EC cancelled Sarowar's candidacy.
The BNP candidate later filed an appeal with the High Court, and on January 27, 2026, the court ordered the restoration of his nomination for the Chattogram-2 constituency.
Appeal and High Court's Decision
However, Muhammad Nurul Amin filed a petition seeking leave to appeal against the High Court order. The Appellate Division of the Supreme Court subsequently granted leave to appeal and ordered that if Sarowar Alamgir was successful in the election, the declaration of his result would remain stayed until the final disposal of the appeal.
Following the Appellate Division's directive, the High Court, after hearing the matter, today made the rule absolute, thereby declaring Sarowar Alamgir's nomination valid.
Legal Representation
Senior jurists AM Mahbub Uddin Khokon, Ahsanul Karim and Nasir Uddin Ashim argued for Sarowar Alamgir, while Advocate Mohammad Shishir Manir stood for the Jamaat-e-Islami candidate. Advocate Raju Miah represented EC at the hearing.

This decision allows Sarowar Alamgir to proceed with his candidacy for the Chattogram-2 constituency. However, the final outcome of the election will be subject to the resolution of the appeal filed by Muhammad Nurul Amin.
