# Law Minister Announces Review of Politically Motivated Cases for Possible Withdrawal

Law, Justice and Parliamentary Affairs Minister Md Asaduzzaman today said politically motivated cases that are yet to be withdrawn are being reviewed through the legal process and would be withdrawn in phases after proper scrutiny.

The minister made the announcement while replying to a supplementary question from opposition lawmaker Md Abdul Alim of Bagerhat-4 constituency during the Question-Answer session in the Jatiya Sangsad.

## Committees Formed for Case Examination

Md. Asaduzzaman said a committee headed by the Deputy Commissioner has been formed in each district to examine politically motivated cases for withdrawal. The recommendations of these committees are sent to another committee headed by the law minister through the Ministry of Home Affairs.

The second committee examines every case from a legal perspective before taking appropriate decisions on withdrawal. The minister assured that this process would continue in the future as well.

## No Withdrawal for Convicted Persons

The minister clarified that the government has no authority to withdraw cases involving convicted persons. If an appeal against a conviction is pending, it must first be disposed of by the court.

After disposal of the appeal, the convicted person may apply to the Ministry of Home Affairs under Section 401 of the Code of Criminal Procedure. The ministry would then seek the opinion of the Ministry of Law, Justice and Parliamentary Affairs before the matter is placed for a decision by the President regarding remission or pardon in accordance with the law.

## Constitutional Provisions and Legal Procedures

The law minister also mentioned that Article 49 of the Constitution provides an opportunity to seek presidential clemency. Applications in such cases are processed through the Ministry of Home Affairs, while the law ministry provides its legal opinion.

He reiterated that there is no provision for withdrawal of cases against convicted persons, although they may seek remission of sentence or presidential pardon through the legal procedures prescribed by law.
